These Terms of Service ("Terms") govern your access to and use of Safe Harbor Way, including our website at https://www.safeharborway.com, our web application at https://app.safeharborway.com, and any related services (collectively, the "Services"), provided by Strategic Business Intelligence, Inc. ("we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent that you meet this requirement.
Safe Harbor Way is a self-guided digital tool designed to help individuals interrupt urge-driven contact with a former partner and manage necessary, unavoidable contact in a deliberate, on-purpose way. The Services include guided in-the-moment techniques ("Emergency Mode"), tools for managing necessary contact, and optional reflective features ("Recovery Mode").
The Services are not a substitute for professional medical, psychological, or psychiatric care, and are not designed, intended, or represented to diagnose, treat, cure, or prevent any medical or mental health condition. The Services are not monitored in real time, are not a crisis intervention or emergency response service, and are not equipped to respond to situations involving risk of harm to yourself or others. If you are experiencing a medical or psychiatric emergency, or believe you or another person may be in danger, contact emergency services (911 in the United States) or seek immediate professional care.
Access to certain features of the Services requires a valid purchase and account activation. You are responsible for maintaining the confidentiality of any activation link or access credential associated with your account, and for all activity that occurs under your account. Notify us promptly at hello@safeharborway.com if you believe your account has been accessed without authorization.
Purchases made through the Services are processed by our third-party payment processor, SamCart. By making a purchase, you agree to SamCart's applicable terms in addition to these Terms. Pricing, refund eligibility, and any promotional terms will be presented to you at the time of purchase. A full refund revokes access to paid features of the Services; it does not affect your ability to contact us for support or to request deletion of your data.
Certain features of the Services allow you to enter personal reflections, written memories, or descriptions of your circumstances ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited license to store and process it solely for the purpose of providing the Services to you. We do not use User Content for any other purpose, including marketing, without your separate consent. See our Privacy Policy for details on what User Content is collected, how it is stored, and how you may request its deletion.
You agree not to: (a) use the Services for any unlawful purpose; (b) attempt to gain unauthorized access to the Services or any related systems; (c) interfere with or disrupt the integrity or performance of the Services; or (d) use the Services to harass, threaten, stalk, or harm another person.
The Services, including all associated content, design, and software, are owned by Strategic Business Intelligence, Inc. or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services except as expressly permitted by these Terms.
The Services use the following third-party assets:
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, STRATEGIC BUSINESS INTELLIGENCE, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms. You may stop using the Services at any time.
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
